The Chairman of the Action People's Party in Ogun State, Moshood Adeshina has dragged both the National chairman of the party, Barr Uchena Nnadi and the Independent National Electoral Commission to court over alleged attempt to 'illegally' remove from office.
The court suit has the APP, INEC, the National Chairman and Secretary of the party as the 1st, 2nd, 3rd and 4th defendants respectively.
A Federal High Court in Abeokuta Judicial Division, Ogun State has summoned the defendants to appear before the court for hearing of the application.
Meanwhile, the court declared that pending the hearing, the plaintiff, Adeshina remains the party Chairman of the party.
The suit reads in part, "A declaration that the plaintiff is the duly appointed and authentic Chairman of the Action Peoples Party, Ogun State chapter, and his purported removal is illegal, unconstitutional, and of no legal effect.
"A declaration that the appointment, subsequent to that of the Plaintiff, of any other person as the Chairman of Ogun State by the ist defendant without the due process of law by the 1st, 3rd or 4th defendants is illegal and unconstitutional, and of no legal effect.
"An order directing the and defendant not and never to recognize anybody or any other person other than the plaintiff, Alhaji Moshood Adesina as the Authentic Chairman of the Action People's Party."
